WorkCompCentral reached out to RPNA’s David Ginsburg for comment on the U.S. 9th Circuit Court of Appeal ruling that FedEx workers are employees, not independent contractors. Ginsberg said in the August 29 article that the case adds to the body of law available for applying the right-to-control test, but otherwise relies on existing concepts. “I don’t think the opinions go beyond application of the multi-factor test and prior case law on the subject,“ he said. “But I would say that the opinion shows that the right to control can be dependent on what work is being done and how it is performed.
