RPNA Partners Drew Pomerance and Vince Gannuscio last week won a jury trial against a major workers’ compensation insurance carrier, when the jury rendered its verdict in favor of RPNA’s employer client. The carrier originally sued RPNA’s client, a nurse staffing company, back in 2015, alleging that the employer failed to properly report all of its payroll, and thus owed it substantial additional workers’ compensation premiums. RPNA first got involved in the case in 2018 to pursue an appeal after a judgment had been entered against its client by the trial court. RPNA successfully obtained a published decision from the Court of Appeal in 2020 which reversed the earlier judgment, thus allowing the employer to go to trial against the carrier and present its defenses. That case just concluded after a nine-day jury trial in the Riverside County Superior Court in Palm Springs. The jury’s verdict was that the insurance company had failed to prove that it was owed any additional premium from RPNA’s client.
Although RPNA anticipates a slew of post-trial motions and ultimately another appeal, it is always gratifying to win a jury trial. This past week’s victory was the latest in a long string of trial and appellate victories that RPNA has won on behalf of employers in their disputes with workers’ compensation insurance carriers.
