Gary A. Nye has been practicing law since 1986. He represents the business community in all aspects of commercial litigation and business transactions including employment, insurance, real estate and corporate disputes.
Mr. Nye serves as outside general counsel to small, medium and large businesses. He represents organizations and executives on matters involving business formation, operations, labor and employment issues, strategic planning and risk management, as well as growth related opportunities and challenges. Mr. Nye offers clients an extensive commercial litigation practice, representing businesses throughout the state on the full spectrum of claims.
Mr. Nye also represents numerous surety and insurance companies, as well as insurance agencies throughout the United States. Mr. Nye has developed multi-dimensional expertise in insurance law as it relates to surety bonds, government liabilities and insurance bad faith. He has represented numerous insurance companies in both claims and bad faith actions.
Mr. Nye also has broad experience in all aspects of corporate and business transactions. In the transactional area, Mr. Nye’s experience includes the representation of both buyers and sellers in the sale of a variety of businesses, all aspects of business formation and capitalization, as well as the preparation of all types of general business agreements.
Mr. Nye has served as a commercial mediator and arbitrator on the Los Angeles Court Panel of Judicial Arbitrators, and is a frequent guest speaker on legal issues pertaining to surety and general business.
ACCOMPLISHMENTS
In connection with his extensive commercial litigation practice, Mr. Nye has represented certain clients in numerous matters involving the following subjects:
Representation of various businesses in the successful defense of class actions arising out of claims asserting Labor Code violations and unfair business practices under the Business and Professions Code
Serving as lead counsel in class action claims relating to a business’ independent contractor classification of its sales force
Numerous cases in a variety of different industries involving shareholder disputes, operating issues, corporate dissolution and employment related issues
A variety of matters against former employees and competitors for unfair competition, violation of trade secret laws, and unfair business practices
Representation of insurance agencies in litigation against governmental agencies seeking claims related documentation under the Freedom of Information Act
Mr. Nye also represents numerous surety and insurance companies, as well as insurance agencies throughout the United States. Mr. Nye’s expertise in this area includes the:
Representation of the plaintiffs in the matter Amwest v. Reno, et al., resulting in a landmark settlement pertaining to the administration of Federal surety bonds
Representation of numerous clients against the federal government challenging the federal governments’ administrative procedures with respect to bond breach procedures
Representing surety insurers on all aspects of very large bond claims including construction bonds, workers compensation deposit bonds and self-insurance bonds
Representing insurance companies in significant disciplinary and administrative matters involving the California Department of Insurance, as well as regulatory matters before the legislature
