RPNA OBTAINS OPINION FOR
CALIFORNIA EMPLOYERS TO SUE CIGA FOR BREACH OF DUTIES
Los Angeles, CA, May 29, 2009—Nicholas Roxborough and Drew Pomerance
obtained on May 29, 2009 a successful opinion from the Second
Appellate District, Division 5 of the Court of Appeals of the State
of California. The case is titled Bi-Coastal Payroll Services Inc,
et al v. California Insurance Guarantee Association, Court of
Appeals Case No.B205969.
This published Opinion holds that California
employers may sue the California Insurance Guarantee Association (CIGA)
for breaching its duties under the Guarantee Act, specifically,
under Insurance Code §1063 et seq.
CIGA had previously obtained a dismissal of the
Bi-Coastal Payroll Services Inc. law suit as CIGA argued that it was
immune from this type of civil law suit. This case is the first of
its kind to clarify a prior Supreme Court Decision, Isaacson v.
California Ins. Guarantee Association (1988) 44Cal. 3rd 775. A key
